Recruitment of a Study Office for the preatable evaluation of charges and resources to the transfer of compete shared between the State and the territorial collectivitis in the sect
The decentralization process initiated for a few years by the Togolese government, has seen the adoption of several instruments and measures, including law n ° 2007-011 of March 13, 2007 relating to decentralization and local freedoms modified by law n ° 2018-003 of January 31, 2018, Law n ° 2019-006 of June 26, 2019, Law n ° 2021-020 of October 11, 2021 and law n ° 2022-011 of 04 July 2022. This law provided not only the creation of local authorities, the organization of local elections, the equipment and operationalization of said local authorities, but also the sharing of skills between the State and these. Also, it has in its article 304 that the charges corresponding to the implementation of the shared skills allocated to local authorities are subject to an assessment prior to the transfer of said skills.
Indeed, the aforementioned 2007 law provides in its articles 83 and 234 skills shared between on the one hand the State and the municipalities and on the other hand, between the State and the regions in various fields. With regard to municipalities, health, education, water and sanitation have already been the subject of decrees n ° 2023-046/PR and n ° 2023-047/PR of June 1, 2023 and decree n ° 2024-030 bis/PR of April 09, 2024.
Thus, these skills transfers must be accompanied by a rigorous assessment of charges (human, financial, material) and corresponding resources to guarantee the efficiency and sustainability of public action at the local level.
In addition, in accordance with Togos commitments in terms of childrens rights (notably through its collaboration with UNICEF), it is imperative that this reform takes into account the specific needs of children and adolescents, in connection with their right to quality education, accessible, inclusive and protective. These considerations must be integrated into future municipal development plans (PDC).
